Terms
Organisation terms
Last updated 23 October 2026
These are the terms for an organisation using Benchmark Lab: setting it up, keeping its list of people, inviting them to answer our indices, and seeing its own results. When someone sets your organisation up on Benchmark Lab, they accept these terms on its behalf.
The people who answer an index agree to our Index terms of use themselves. Those are between each of them and us, and nothing on this page changes them.
1. Who we are
Benchmark Lab is a trading name of The AI Adoption Lab Limited, a company registered in Scotland under company number SC900444, whose registered office is 5 South Charlotte Street, Edinburgh, EH2 4AN. In these terms, "we" and "us" mean The AI Adoption Lab Limited, and "you" means the organisation using Benchmark Lab. The contracting party is the company, not the trading name.
A partner may have introduced you to us - a membership body, a trade association, an IT partner, or The AI Lab, which is another trading name of this same company. Whoever introduced you, the indices are ours and these terms are between your organisation and us.
2. What Benchmark Lab does for you
Your people answer one or more of our indices, one index at a time. Every index is one of two kinds. An organisation index asks about your organisation: the people you choose answer it for you, as many as you like, and its result is shown from the first of them, as a report you can read and come back to. Your people can also answer one without being asked and ask you to count it; it counts only if you agree, and you can turn this off. A personal index asks each person about themselves: their result is theirs, and you see only combined figures from people who took it through your link, from enough of them that nobody's result can be picked out. You can run an index again whenever you like and see how the result moves.
It costs you nothing. There is no charge for your people answering an index, or for your organisation's own report on each index.
If you also agree paid work with us - Business Memory, or anything else - that is a separate written agreement. Nothing on this page obliges you to buy it, and where that agreement and these terms cover the same ground, that agreement wins.
3. Who can act for you
Whoever sets up your organisation confirms four specific statements: that they work for you, that you have authorised them to keep your list of people on Benchmark Lab and to invite colleagues to answer our indices, that colleagues they invite will be emailed by Benchmark Lab on your behalf, and that they, the person setting up, will see who has responded, with somebody who declines counted as having responded, and will see your organisation's results, which on an index answered for your organisation can be one colleague's answers, rounded. We record those statements, who made them and when, and we let other people we already hold on your email domain know that someone has set your organisation up.
Those statements are the basis on which we act for you. If they were not true, tell us and we will suspend your organisation while it is put right.
4. Your list of people
- Keep it accurate, and remove people who have left.
- Only add work addresses, and only for people who work for you.
- Tell your staff that you use Benchmark Lab to measure how you work. You are far better placed to do that than we are, and it is your responsibility, not ours.
When we invite someone at your request, the email shows the name of the person who asked, and tells them where we got their details and how to say no.
5. What you see, and what you do not
You see a result for your organisation for each index your people have answered: the headline figures, the areas underneath them, and how they move over time. On a personal index, where too few people have answered, there is no combined result at all.
You never see anyone's answers to the questions. That is not a setting; Benchmark Lab cannot show them to you. On an organisation index, the people you choose answer for your organisation: their answers are combined question by question and never shown to you one by one, but if only one person has answered, the result is their answers, rounded.
Where we offer it, everybody at your organisation who can see its results can also read a report written for your organisation by an AI model from your own results, alongside your organisation's report. It is free while Benchmark Lab is in beta.
You see who has responded and who has not responded yet. You do not see who declined. Somebody who answers and somebody who refuses both appear as responded, and that is deliberate: it means refusing costs your colleague nothing.
6. Partners
If a partner introduced your organisation to an index - you or your people used their link - they see how many people from your organisation have taken part, as a range rather than an exact number. They do not see your organisation's name or its result.
Whether they see more is your decision, and only yours. On your account pages, whoever has authority to act for your organisation can choose to share with that partner. Sharing lets them see your organisation by name and its headline figures for the indices you share - on an organisation index, rounded, from the people who ticked the box saying their answers count as your organisation's - and have their own report about your organisation, an Account Manager Report, prepared for the people at that partner who work with you. That report is written by an AI model from your results and from what you have told us about your organisation (on an organisation index, from the answers of the people who ticked the box saying their answers count as your organisation's, who still work there, answered in the last nine months and answered through that partner's links, area by area, which can be one person's), nobody edits it before they read it, and you are not told each time one is prepared. They never open your organisation's own reports, on any index. Nobody's answers to the questions are ever shared. Where an organisation index's result is one person's answers, sharing it shares those figures. On a personal index, a partner you share with sees only its combined figures, from enough people that nobody's result can be picked out, and never anyone's own result.
One decision covers every index that partner introduces you to, including any later one, and you can exclude any single index. You can stop sharing at any time, and it stops from that moment; it cannot take back a copy the partner has already downloaded. A partner may ask you once to share. You can say not now, and they are never told what you decided.
A partner outside our company holds what it receives because you shared it under its own responsibility. Where you share, a partner can also show your organisation's result to people at your organisation who can already see it, on the partner's own website. A partner may publish figures about the organisations it has introduced, grouped so that no organisation can be identified in them.
If a partner introduced you to an index, our emails and reports about that index may carry their logo beside ours.
7. Using it fairly
Benchmark Lab measures an organisation, not a person. So:
- Do not use it, or anything in it, to manage, appraise, rank or discipline an individual.
- Do not press colleagues to answer an index, and do not treat someone differently because they did not.
- Do not try to work out an individual's answers from a combined result - for example by inviting people in ones and twos and comparing the results.
- Do not treat an organisation index's result as a verdict on the people who answered it: they answered for your organisation, at its request, and where only one did, the result is their view of it.
If we think Benchmark Lab is being used against the people answering it, we will suspend your organisation. We would always rather talk to you first.
8. Data protection
We are the controller of the list of people your organisation keeps on Benchmark Lab and of the invitations we send from it. We hold and use them on our legitimate interest in running our indices for the organisations that use them, as our privacy notice explains.
If we agree in writing to do something else for you with information you give us - for example, to load a list of people you send us - we do it on your instructions, under that written agreement, and not under this section.
The answers are not yours. When one of your people answers an index, they are dealing with us directly, and we decide what happens to their answers. You cannot obtain them, correct them or ask us to delete them, and we will not act on an instruction from you about them. If your colleague wants something done with their answers, they ask us themselves.
The AI Adoption Lab Limited is registered with the UK Information Commissioner's Office under registration number ZC251110.
9. What may change
Because Benchmark Lab is free to you, we do not promise it will always be available. We may change the questions, change how a result is worked out, add or withdraw an index, or stop offering Benchmark Lab. If the questions change, results taken before and after are not always directly comparable, and we will say so where it matters.
We do not promise that it will always be free. If we ever charge for something you use today, we will tell you before it affects you, and it never changes what you have already been given.
You can stop using Benchmark Lab whenever you like. Tell us and we will close your organisation and stop inviting your people. Your colleagues keep their own results: those are theirs, not yours, and closing your organisation does not remove them.
10. What we can and cannot promise
We will provide Benchmark Lab with reasonable skill and care. A combined result tells you how your people answered an index's questions, and nothing more. It is not professional advice, it is not a measure of anyone's performance, and it is not on its own a basis for a decision about a person or a budget.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Subject to that, our total liability to you in connection with Benchmark Lab under these terms is limited to £100.
That limit is about the free service on this page and nothing else. If you have paid us for anything, what we owe you for it is set out in the agreement you made for it, and this section does not apply to it, limit it or reduce it.
11. Changes to these terms
We may update these terms. If a change matters to you, we will tell the people who act for your organisation before it takes effect. We record which version was accepted, by whom and when.
12. Law
These terms are governed by the law of Scotland, and disputes are subject to the courts of Scotland.
